India: Update on Citizens for Democracy police complaint against hate incitement by Akhil Bhartiya Hindu Mahasabha

The Hindu Mahasabha GS Munna Lal Shukla gave a statement that attack on churches are legal and Taj Mahal would meet the fate of Babri Mosque.It appeared in press on April 22, 2015. Well-known lawyer Mr. N. D. Pancholi filed complaints to police in UP and Delhi on April 22, 2015. Delhi police commissioner Mr. Bassi took cognizance of the complaint and referred the issue to special cell. The further developments are contained in the accompanying email of Mr. Pancholi

Dear Sir,

This is with reference to my complaint Reference No. 6499/E-mail dt.23.04.2015 addressed to Shri B.S.Bassi, Police Commissioner, Delhi regarding provocative and insulting remarks make by Shri Munna Kumar Shukla, General Secretary of the Akhil Bhartiya Hindu Mahasabha, Mandir Marg, New Delhi against the Christian and Muslim community. My complaint was acknowledged by your mail dt.27.04.2015 whereby the above reference number was given and I was informed that the same had been forwarded to the Joint Commissioner of Police/Spl. Branch for further action.

In this connection I inform you that yesterday (2nd May 2015) I was contacted by one Shri Dharmendra, Sub Inspector, of Mandir Marg Police Station, New Delhi who asked me to meet him in the police station regarding certain queries about the above complaint. I met him yesterday at 6 PM at the police station and briefed him as to why this complaint was made. I also handed over to him following documents :

(1) Original copy of “The Hindu†newspaper (daily) dt.22nd April, 2015 in which the offensive remarks were published.

(2) Copy of the Press Statement dt.21.04.2015 in Hindi circulated by the Akhil Bhartiya Hindu Mahasabha to the Press by e-mail with the following caption :

“CHARCHON KO TODNE WALE HINDU VEERON KAA SANRAKSHHAN KARE KENDRA SARKAR, HINDU MAHASABHA POORAN SARANKSHAN KAREGI†. Munna Kumar Sharma

(Central Govt. should provide protection to brave Hindus who indulge in destroying churches, Hindu Mahasabha will give them total protection – Munna Kumar Sharma)

(3) Mobile number of Shri Mohd. Ali, the journalist of ‘The Hindu’ who had received The said statement for publication. i.e. (Mobile No. [. . .removed here to protect privacy . . ])

(4) My residential address. The office address give on my complaint is the address of Shri Kuldip Nayar, the revered journalist & diplomat who is the President of the Citizens For Democracy.

The offensive statement was issued from the Mandir Marg, New Delhi office of the Akhil Bhartiya Hindu Mahasabha on its letter head and was circulated to the Press through its e-mail ID.

In view of above there seems to be no impediment in taking appropriate action in accordance with law against the accused.

It is further submitted that one Dharampal Siwach, the president of the Jeend unit of the Akhil Bhartiya Hindu Mahasabha (Haryana) in a statement issued on 23.04.2015 from Jeend has declared an award of Rs. Five lakhs to be given to any person who will assassinate Swami Agnivesh ( Swami Agnivesh Ka Sar Kalam Karne Par Hindu Mahasabha Ne Rakha 5 lakh ka inaam.) This news was published on the Web Desk of ABP News dt.23rd April, 2015. I am attaching a copy of the same for your perusal.

If no early action is taken against the accused, they would go on spreading venomous statements and vitiate the communal atmosphere in the country. Therefore early action will be appreciated.
