Subject: Landmark Judgement of Nepalese Supreme Court
Nepalese Supreme Court gave landmark judgement that serious crimes should not be the subject of Amnesty and declared ultra vires a several provisions of - Commission on Disappearance and Truth and Reconciliation Commission Act. The 234 conflict victims and their organizations filled petition in Supreme Court to challenge tthe CoD and TRC act. I represented the side of victims in Supreme Court.
The Major points of Supreme Court judgement:
No Amnesty for serious crimes such as - War crimes, disappearances,
Torture, rape etc.
Commission can not take away the power of the Court.
No statute of limitations for serious crimes.
The act of disappearance needs to be criminalized.
Consent of the victims is must for reconciliation
Recommendation made for prosecution by Commission is mandatory.
